Use of this system requires that you acknowledge the filing date for a document shall be the date the agency receives the complete document. Any document received by the office of the agency clerk after 5:00 p.m. shall be officially filed as of 8:00 a.m. on the next regular business day.
By using this system, you agree that you are authorized by the facility to submit documents on its behalf.
A complete petition for a variance or waiver, including all accompanying documentation, must be submitted for each individual facility. There is no exception for facilities under common ownership, and documents may not be incorporated into any petition by referring to another facility’s petition. Each petition must contain sufficient information and supporting documentation to stand alone for purposes of adjudication.
The Department may, after receipt of a petition for variance or waiver, request additional information from the facility in accordance with Section 120.542(7), Florida Statutes (F.S.). Please refer to the statute for more information. The Department shall grant or deny the petition within 90 days after receipt of the original petition, the last item of timely requested additional material, or the petitioner’s written request to finish processing the petition.
Service of documents, such as a Request for Additional Information or a Final Order, will only be performed on the individual listed in the “Document Service Information” fields . If an e-mail address is submitted, the Department will serve documents to that address only, unless another method is requested in the comment box. By using this system, you are affirming that the contact information submitted as “Document Service Information” is accurate and waive any right to assert a lack of jurisdiction due to failure of service in any subsequent proceeding concerning your request.
